Announcement of the UK’s new Points Based Immigration System

The UK government yesterday published its policy statement on the UK’s new points based immigration system, which will enter into force from 01.01.2021.

From 01.01.2021,  all non-UK nationals (including EU nationals) will require a visa to work or study in the UK.

As a pre-requisite, everyone who applies for a work visa will need to show that they have a job offer from an approved sponsor, that the job offer is at the required skill level and that they speak English.

There will be a basic salary threshold of £25,600 that all individuals who wish to travel to the UK will need to meet.

The salary threshold is ‘tradeable’ against a bare minimum salary of £20,480, where an individual can show that they are able to meet other criterion such as the job being in a shortage occupation or the individual having a PHD in a subject relevant to the job.

The resident labour market test ( requiring an employer to evidence that there are no suitable applicants from those who are already settled in the UK ) will be suspended and individuals earning less than the bare minimum salary of £20,480 will no longer have a route to work in the UK.
